Terms & Conditions
The Client expressly waives its own standard terms and conditions, even if drafted after these Terms and Conditions. Any deviation shall only be valid if expressly agreed in advance, in writing, by PUBLIDUPLO – Technology & Services, Lda. (“PUBLIDUPLO”).
PUBLIDUPLO manufactures, distributes and sells LED displays, security cameras and advertising products (“Products”), which the Buyer purchases from PUBLIDUPLO. Unless otherwise stated in the Agreement or Quote, and in accordance with this Limited Warranty (“Limited Warranty”), PUBLIDUPLO provides the Buyer with a Limited Warranty on components, including Standard Limited Warranty and Extended Limited Warranty when applicable.
This Limited Warranty does not include on-site labour charges, unless PUBLIDUPLO, at its own discretion, decides to provide such service.
PUBLIDUPLO SHALL ONLY BE OBLIGATED TO HONOUR THE WARRANTY AFTER RECEIPT OF FULL PAYMENT FOR THE PRODUCTS.
1. Warranty Coverage
1.1. A Ga1.1. This Warranty covers manufacturing defects or quality-related issues, defined as material deviations from the specifications or the Agreement that prevent the normal operation of the Products.
For LEDs, defects are defined as pixels that cease to emit light.rantia cobre exclusivamente defeitos de fabrico ou anomalias relacionadas com qualidade, entendidos como desvios materiais às especificações ou ao Contrato que impeçam o funcionamento normal dos Produtos.
No caso dos LEDs, consideram-se defeitos os píxeis que deixem de emitir luz.
1.2. Warranty Invalidation
PUBLIDUPLO is not obliged to provide warranty service if the Products are altered without prior written authorization.
Any modification, repair, or intervention performed by anyone other than PUBLIDUPLO or its authorized service agents automatically voids the Warranty.
The Warranty is also void if the original product identification label is removed, altered or illegible.
2. Warranty Claims and Procedures
2.1. Notification
During the Warranty Period, the Buyer must notify PUBLIDUPLO in writing within seven (7) calendar days after discovering any defect.
2.2. Return of Products
Products returned for repair, replacement or credit must be properly packaged using double-layer protective materials.
The Buyer bears all risks of damage or loss during transportation.
2.3. Expenses
Unless otherwise agreed in writing:
– The Buyer covers the shipping of Products to PUBLIDUPLO;
– PUBLIDUPLO covers return shipping via standard ground transport;
– Expedited shipping or customs duties shall be borne by the Buyer.
2.4. Spare LED Modules – Reservation, Storage and Replacement Process
a) For every LED display order, PUBLIDUPLO automatically reserves a batch of spare LED modules produced from the same manufacturing lot as the delivered display.
b) These spare modules are stored either:
– at PUBLIDUPLO’s warehouse by default; or
– at the Buyer’s warehouse, upon written request.
c) In the event of a module failure, the Buyer must request a spare module via email, providing the serial number of the display or module.
d) The Buyer may:
– collect the spare module directly from PUBLIDUPLO’s facility, or request shipment (costs according to Clause 2.3);
– deliver or ship the defective module to PUBLIDUPLO for diagnostics, repair or replacement.
e) After repair or replacement, the repaired (or new) module will be reintegrated into the Buyer’s spare stock, restoring the original reserved spare module count.
3. PUBLIDUPLO’s Obligations
PUBLIDUPLO’s obligations under this Warranty are limited, at its sole discretion, to:
3.1. Repairing the Product and maintaining the remaining Warranty Period;
3.2. Replacing the Product with a new, rebuilt or functionally equivalent component;
3.3. Issuing a credit note based on the residual value of the Product.
All replaced components become the property of PUBLIDUPLO.
4. Service Methods
4.1. Remote Technical Support via telephone, email or other tools.
4.2. Return Material Authorization (RMA) when remote support is insufficient.
4.3. Advanced Replacement, allowing shipment of replacement parts before defective ones are returned.
4.4. On-Site Service, with labour charges according to the PUBLIDUPLO Service Price Book.
4.5. Buyer Obligations
The Buyer must ensure adequate access, facilities, permits, equipment, electricity, workforce, and safe working conditions.
Delays caused by the Buyer will result in additional travel, lodging and labour charges.
5. Warranty Exclusions
This Warranty does not cover:
5.1. Damage during shipment (unless agreed otherwise);
5.2. Normal wear and aging of components;
5.3. Natural reduction in brightness or gradual colour shift;
5.4. Minor brightness or colour differences not affecting functionality;
5.5. Damage caused by improper installation, use, operation or unauthorized repair;
5.6. Damage caused by unsuitable environmental conditions, electrical failures, extreme temperatures, humidity, corrosion, natural disasters or improper storage;
5.7. Burn-in caused by prolonged display of static content;
5.8. Statements made by unauthorized resellers or agents not confirmed in writing by PUBLIDUPLO.
6. Limitation of Liability
PUBLIDUPLO’s total liability is limited to the amounts paid by the Buyer for the Products in the twelve (12) months preceding the claim.
PUBLIDUPLO shall not be liable for indirect, incidental, consequential or punitive damages.
7. Disclaimer of Other Warranties
Unless expressly agreed in writing, this Limited Warranty replaces all other warranties, express or implied, including merchantability and fitness for a particular purpose.
8. Governing Law
Any dispute arising from this document shall be submitted exclusively to the Portuguese courts, district of Porto.
